A Tiburon man was arrested after fatally shooting a doe and her fawn that were eating his yard plants.

The animals suffered side wounds and died a prolonged death, according to the Tiburon Police Department and Marin Humane. The fawn lived somewhat longer than its mother.

Mark Thomas Dickinson, a 54-year-old pilot, was booked into Marin County Jail on an animal cruelty count, police said. He was released on bail pending further review by the Marin County District Attorney's Office.

Dickinson did not respond to a request for comment but referred the inquiry to his lawyer, Charles Dresow.

"The Tiburon police should not have arrested my client and booked him into jail," Dresow said. "He had no intent to be cruel or to harm the deer. Rather he was simply trying to scare them away from consuming new landscaping."

The incident occurred at about 5 a.m. Saturday at Dickinson's residence on Mar East Drive, where a landscaped slope leads from the street down to the bayside residence.

A neighbor called police after hearing shots and seeing a flashlight beam outside. Police arrived to find the injured deer and called in Marin Humane, the animal welfare organization, said Tiburon police Sgt. Steve Hahn.

Both deer died before an animal control officer could reach the site, which is at the eastern tip of the Tiburon Peninsula.

Police contacted Dickinson, who said the deer were eating his landscaping. The weapon was a high-powered Gamo pellet-gun with scope, laser and flashlight attachments, Hahn said.

"They died agonizing and painful deaths," Hahn said.

Marin Humane took the dead animals for examination, said spokeswoman Lisa Bloch. The organization will conduct X-rays to see where the pellets penetrated the deer, she said.

Bloch called the incident "really sad and disturbing."

"It did cause great suffering," she said. "There's all kinds of ways to keep deer from eating your landscaping. Their only crime was eating vegetation. They weren't menacing anyone. No one was in danger."

The website for Gamo markets its guns for hunting small game such as rabbits, squirrels, raccoons and crows, and as "pest control" for "nuisance animals such as mice, rats, birds and snakes."

He lives in Marin County, lives in a 2-4 million $$$dollar$$$ house and probably believes he can do whatever he wants. 8)
I've no problem with the price of the house, thems folks helped me make a good living for 20 years, just a problem with most Marin-ites :) FWIW: thems that live in Belvedere are worse than those in Tiburon.

On a lighter note, I would have used my Mrod and drug both deer down to the garage and got myself some doe mutton and bambi veal. Neighbors wouldn't have heard much of anything ;D
Buncha BB guns that I don't get to shoot as much as I like.

The problem is that this sort of behavior can directly affect our hobby. It's how it looks. Shooting rats and squirrels is one thing, but shooting deer with a springer, and having both deer suffer in front of neighbors is not at all good. Facebook has a lot responses to this, and none I've seen are positive.

I agree Steve, but we cannot control what others do. I'm just pointing out the mentality of those that do this sort of thing. Like I said I dealt with the people down there. The tv news is saying a pellet gun, just what we need, huh??. Doesn't say CA Fish and Foul are involved. His fine if convicted will be a pittance. If it even goes to court. :o
Oh, I don't do FB.

I agree, we can't control what some folks do. Heck, they even use replica CO2 handguns to rob stores here in Roswell. I guess we need to do something about that too, just like Canada did. What's next?

Just like anything else, you can't legislate and force intelligence on people. People drive drunk but cars are legal, poaching is poaching whether with a slingshot or a .50 cal., and stereotypes about people is 'deep Marin' (Tiburon, Sausalito, Belvedere, etc.) are well founded. I too make my living off of the 'haves' since I'm a contractor, but the sense of entitlement is appalling. Of course not everyone is like that, but the entitled-asshole ratio is high enough that you have to be on your guard.

I don't think it hurts our sport at all. People generally have their minds made up about things anyway (guns, politics, etc.) and any intelligent person can see the difference. It's not any different than the neighbors of my family-owned dairy who bought property in the country, built mansions, and then complained about being down wind of the smell. Dairy's been here for over 100 years.

The bigger picture here is how big of an asshole this guy is, not that he has an airgun. There are poor assholes, and rich assholes...the size of bank account doesn't differentiate.

That being said, I wonder if it's more acceptable to road hunt with a hybrid?

All great thoughts guys.

No way I'd want to try and legislate any new laws for folks like this. The laws already exist. But I would like to see the guy charged for poaching, illegally using an airgun to hunt a game animal, etc. I'd be willing to bet there are local laws against shooting AirGuns in his town.

Anyway, do folks like this board? I get a Google newsfeed for airgun related news. There's actually a lot read on a weekly basis.
